摘要
采用案例分析、比较研究、资料法等方法对近五年学校体育伤害事故归责进行研究,并与五年前学校体育伤害事故归责研究进行比较,从法学视角对学校责任认定与学生责任认定进行研究,旨在明确学校、教师、家长、学生等当事各方在事故中的法律责任,有效防范和降低体育伤害事故的发生,甚至不发生,为依法治教提供参考依据。
Based on case study,comprative resarch and literature review,this paper has done research into imputation in school sports injury accident in the recent five years. This paper has done a comparison be- tween the accidents and studied the school's responsibility and the students' responsilility in law, so as to i- dentify the legal responsibility of the school, teachers, parents and students, prevent the sports injury acci- dent,and provide reference for the rule of law.
