我国民间慈善组织困境及法治建设

Difficulties and Legal Construction of Non- Governmental Charitable Organizations in China

通过对实际案例、数据的分析,在借鉴已有相关成果的基础上总结出我国民间慈善组织存在的准入门槛高、优惠政策少、自身建设落后等发展瓶颈问题。结合这些问题找到其原因并提出在民间慈善组织的成立、运作和监管方面应加强法治建设,将民间慈善组织管理纳入法治轨道,从而实现民间慈善组织可持续性、健康发展。

Through the analysis of practical cases and data, based on some existing relevant achieve- ments, some problems in the development of non - government charitable organization are generalized, inclu- ding the high criteria of admittance, the less preferential policy and their backward self - construction. Com- bined with these problems, causes about them are found out. Finally, it is proposed that government should strengthen the legal construction in the foundation, operation and supervision of non - government charitable or- ganization, bring the administration of non - government charitable organization into legal orbit, and thus realize the sustainable and healthy development of non - government charitable organization
