摘要
海洋石油开发油污事故责任限制仍有存在的合理性。但是,海洋石油开发设施不属于船舶,船舶油污责任限制的规定对其不能适用。在能够确定溢油量的情况下,不妨采取"溢油量"标准确定海洋石油开发油污事故的最终责任限额;否则,适用"事故制"方式确定。美国墨西哥湾油污事故后,废止责任限制的呼声很高,然而责任限制仍得以坚持,在责任限额逐步提高的背景下,应通过保险制度实现高度危险责任的社会化救济。
There is the rationality of the existence on oil pollution accident liability limitation in the develop- ment of offshore oil. However, offshore oil development facilities do not belong to the ship, provisions of liabil- ity limitation on ship oil pollution cant be applied. Under this circumstances of determining the amount of oil spillage, we might as well take " the amount of oil spillage " as standard to liability limitation; Otherwise, " accident system" is suitable. After gulf of Mexico oil pollution accident in the U. S, Some people consider the repeal of liability limitation, but limitation of liability is still adhered, under the background of gradually im- prove in the liability limitation, we should realize the socialization relief of the highly dangerous liability by the insurance system.
