对我国医疗救助立法的现状分析及若干思考

Analysis and Reflection on Current Situation of Medical Relief Legislation in China

我国医疗救助制度所采取的是以政策为保障、以行政为推动的发展模式,而尚无对医疗救助的国家层面立法。文章在分析了我国医疗救助地方立法现状的基础上,提出了我国医疗救助立法应转变立法思路、形成统一的法律体系、保证立法内容体系的完整性和保障立法公开透明性等建议。

The development model of medical relief system in China is guaranteed by policy with administra- tion as its driving force. Based on the analysis of national level legislation of medical relief in our country and the present situation of local legislation, this paper puts forward the following suggestions： change the ideas of medical relief legislation in our country, form a unified legal system, ensure the integrity of the legislation content system, and secure publicity and transparency of legislation, etc..
