从中美医患纠纷调解看医患关系的实质

On the Nature of Doctor-patient Relationship from Doctor-patient Dispute Mediation of China and the United States

近年来,我国医患纠纷呈多发态势,有的"医闹"事件已经严重影响社会治安和侵犯了医护人员的人格尊严、人身安全。本文介绍了中国上海和美国医患纠纷调解的基本情况,并得出"医患关系应当是信任合作关系"的结论;认为我国"医闹"高发的原因是多方面的,医疗体制的不合理与社会利益配置的不公平才是真正的原因,医患之间建立信任合作关系须通过四个方面:应正确宣传医疗行为的特殊属性——具有高度风险性;政府为公众健康谋全局、负总责;医患纠纷预防与调解同等重要;"跨前一步"实现对"医闹"的"零容忍"。

In recent years, doctor-patient disputes occurred frequently in our country, some ＂medical distur- bances＂ have seriously affected the social order and violated medical staff＇ personal dignity and personal safety. This paper introduces the basic situation of doctor-patient dispute mediation in Shanghai, China and the United States, from doctor-patient dispute mediation practice in Shanghai, China and the United States, doctor-patient relationship should be confidence-building cooperation. There are many causes to the high frequency of ＂medical disturbance＂ in our country, and the real causes are unreasonable health care system and the unfair configuration of social interests. Confidence-building cooperation should be built between the doctors and patients from the fol- lowing four aspects： correct propaganda of medical behaviors with high risks; the government seeks the global and overall responsibility for public health; doctor-patient dispute prevention and mediation are equally important; be calm to realize ＂zero tolerance＂ for ＂medical disturbance＂.
