摘要
在国际法"碎片化"的背景下,气候变化单边措施涉及不同类别的国际法与国际自足体制。在审查欧盟航空指令的有效性时,欧盟法和世贸组织法律制度有明显不同的利益偏好。为消除体制间的冲突,更为现实的态度是,应承认国际自足体制的多样性和独立性。利用体制间的对话和相互适应来缓解贸易与环境之间的紧张关系。
Unilateral measures on climate change touch upon various types of international law and self – contained international regimes against the background of "fragmentation" of international law. In terms of reviewing the validity of the EU Aviation Directive, the European Union Law and the WTO legal system have obvious different benefit biases. To address the collision between different regimes, it would be a more realistic approach to recognize the diversity and independence of self–contained international regimes. The tension in the relationship between trade and environment should be remitted through inter–regime dialogues and adjustments.
