权力边界与职责担当：文化治理的“三元”主体格局建构--基于协商民主的视角

Power-Boundary and Responsibility Undertaking: Construction of the Pattern of "Threedimensional" Subjects in Cultural Governance——Based on the View of Deliberative Democracy

文化建设作为中国特色现代化建设的重要内容,是提升国家软实力和维护公民文化权益的重要载体。协商民主作为我国民主政治的独特优势,在"广泛多层制度化"实践中,其"平等""包容"的价值诉求、"交往""商谈"的实践特质和"批判""整合"的思维取向,契合了我国文化建设中"多元治理"的改革诉求和时代趋势。本文提出在打破"全能政府"和"超级保姆"的同时,构建"政府—社会—市场"三元文化治理主体格局,以保持三者权力结构与作用边界的动态平衡;并以协商民主的"宪政体制"框架、"双轨制"机制和"公共理性"原则为导向,以控制政府权力、培育社会组织、规范市场力量三大维度为切入点,界定各治理主体的外在权力作用边界和内在职责担当,最终实现"强公共领域""弱公共领域"和"私人领域"之间的对话与互动,提升文化治理的整体管理效能。

As an important part of modernization with Chinese characteristics, cultural construction is an important carrier to promote national soft power and protect the culture rights and interests of citizen. Deliberative democracy has the unique advantages of democracy in our country, including value pursuit of ＂equality＂ and ＂inclusivity＂, practice trait of ＂communication＂ and ＂negotiation＂, thinking orientation of ＂criticism＂ and ＂integration＂, which all fit the reform demands and trends of ＂multiple governance＂ in cultural construction when ＂extensive multi-institutionalization＂ practices in our country. Building the subject pattern of ＂government- society-market＂ in cultural governance and keeping the dynamic balance of power structure and function boundary of the three are required, at the time of breaking the ＂omnipotent government＂ and ＂super nanny＂. Taking ＂constitutional system＂ framework, ＂dual track＂ mechanism and ＂public reason＂ of deliberative democracy as the guide, we define the external power boundary and internal responsibility of subjects in governance through the breakthrough point of three dimensions of controlling the power of government, cultivating the social organization, and regulating the market forces, and then realize dialogue and interaction between ＂strong public＂, ＂weak public＂ and ＂private sphere＂, in order to improve the overall management effectiveness of cultural governance.
