摘要 明晰的产权关系是优化资源配置的基础,是决定集体建设用地能否流转的前提。目前我国农村集体建设用地流转违规现象严重,隐形市场活跃,政策法规与地方实践冲突,政府行政干预过多,原因就在于没有合理处理好政府与市场的关系。鉴于此,促进农村集体建设用地的合理流转,需通过转变基层政府在土地流转中的职能,建立一体化的城乡土地市场作为集体建设用地流转的平台。 The basis of clear property right relations is to optimize the allocation of resources; is the premise to decide whether or not a collective construction land circulation. At present our country rural collective construction land circulation serious irregularities, contact the market active conflict, policies and regulations and local practice, the problem such as excessive government intervention, the reason is that there is no reasonable deal with the relationship between government and market. In view of this, to promote the reasonable transfer of rural collective construction land; by changing the function of basic unit government in the land circulation, establish the integration of urban and rural land market as a platform for the collective construction land circulation.
