摘要 用人单位应按照法律规定的相关程序,向工伤保险经办机构申请、报送有关材料,帮助工伤职工领取一次性工伤医疗补助金。工伤职工提出解除劳动合同的申请符合法律规定,用人单位应依法解除,并支付相应的补助金。用人单位不同意解除致使时间拖延、形成诉讼的,一次性工伤医疗补助金和一次性伤残就业补助金按数额较高的、判决解除劳动合同时而非职工提出解除时的统筹地区上年度职工月平均工资计算。 The employing units should be in accordance with the relevant procedures as prescribed by law, the relevant materials submitted to the agency for help, work injury insurance, inductrialinjury worker receive a one-time injury medicaid. Injured workers terminate labor contract application complies with the law, the employer shaUterminate according to law~ and pay the corresponding compensation. "Ihe employer does not agree to terminate the time dehy~ the formation of a lawsuit, a one-time injury Medicaid and one-time grants for the disabled in employment in higher amounts, the decision to lift the average wage ofworkers and non urban areas when releasing the staff and workers in the previous year month.
