摘要
邮政送达是人民法院审理民事案件的常用送达方式,最高人民法院出台了《关于以法院专递方式邮寄送达民事诉讼文书的若干规定》,对于法院迅速准确送达相应法律文书起到了积极作用,但在运行过程中也出现了三方面问题:法院的邮寄送达偏好及忽视代理人送达;当事人送达地址认识偏差及轻视损害自身知情权;邮递机构投递不规范,亟待监督与规范。针对上述问题,应分析原因,寻求出立体综合化解决方案,以保障当事人知情权与监督权。
Marl service is a widely-used method when people's court hears a civil law case. Supreme People's Court has issued Provisions on Using the Court Special Delivery to Marl Service Civil Litigant Documents, which encourages the court to rapidly and precisely service the relevant litigant documents. However, there are three issues in the process: preference of the court's marl service and ignorance of the representative's service; deviation of the party's service address and the belittling of the prejudice the right to know; the irregular service of the marl institutions must be monitored and standardized. The causes of those flaws should be analyzed and comprehensive solutions should be approached to protect the party's right to know and monitor.
