领导干部干预司法活动问题研究——基于审判中心主义的视角

《领导干部干预司法活动、插手具体案件处理的记录、通报和责任追究规定》这一旨在确保司法机关独立公正行使职权的规定于近日正式公布实施,法院作为我国主要的司法机关,充分保障法院独立行使审判权力是此规定的核心。在我国,领导干部干预司法活动、插手法院审判具体案件的行为具有不同的类型化特征,具体到刑事诉讼中,存在着一种较为特殊的干预司法活动、尤其是干预法院独立行使审判权力的行为,这主要指在刑事诉讼过程中侦查机关、公诉机关的领导干部对法院的案件审判程序的干预和影响。根据审判中心主义的内涵,确保法院独立行使审判权力是审判中心主义的应有之义。因此,从审判中心主义的视角审视和丰富这项规定的内涵,通过更加细化的规定使其在刑事诉讼中具有实践价值无疑是具有现实意义的。

Therefore, examine and enrich the connotation of this provision from the perspective of the trial centrism, by more detailed regulations to have practical value in the criminal proceedings undoubtedly have practical significance.
