“气候难民”应受国际法的保护

Climate Refugees Should Be Protected by Law

从国际法当前的理论与实践来看,"气候难民"不属于国际难民的范围,不受国际法的保护。文章系统分析了国际法保护"气候难民"的必要性,认为,全球环境危机影响着人类的健康,尤其是气候变暖导致海平面上升,已经淹没了海拔较低国家的领土,严重威胁着人类的生存,由此而导致的"气候难民"如同国际难民一样,不能返回原住地,因此应当受国际法的保护。在此基础上提出具体措施,预防出现"气候难民"和保护"气候难民"的合法权利。

From the perspective of the theory and practice of the current international law, ＂climate refugees＂ does not belong to the scope of the international refugee, is not protected by international law. Based on the system anal- ysis of the necessity of international law to protect ＂climate refugees＂ , the paper holds that global environmental crisis affecting human health, especially global warming and sea level rise has flooded the low-lying country＇s tern- tory, a serious threat to the survival of humanity, thus leading to ＂climate refugees＂ as international refugee same can not return to their places of origin, and therefore should be protected by law. On the basis of this, puts forward specific measures to prevent ＂climate refugees＂ and to protect the lawfi.furights of the ＂climate refugees＂.
