摘要
实务中对于鉴定意见过分"迷信"使其具有"裁判性",而由此所带来的是法官职能的退化。文章分析了强化法官职能的必要性,并提出通过改变法官的审判观念、贯彻无病推定原则以及制定《精神障碍鉴定法》来强化法官职能的建议。
In practice, blind belief in experts＇ opinion resulted in the ＂justiciability＂ and degraded functions of the judges. This paper analyzes the necessity of strengthening the functions of judges, and puts forward the following suggestions： changing the judges＇ trial notions, implementing the disease-free estimation principle, and laying down The Law of Mental Disorders Appraisal, etc..
