台湾地区司法社会化改革研究

A Research on the Judicial Socialization Reform in Taiwan

台湾在经历了司法专业化、特殊化、独立化的内部改革后,司法改革进入司法社会化的外部改革时期。台湾司法社会化改革不但缘于改变台湾民众不信赖司法的社会现状的急迫需求,更有赖于各方基本共识的达成和各种力量的不懈推动。台湾司法社会化改革的进路和内容包括角色的社会化、人事的社会化、管理的社会化和审判的社会化等方面。台湾司法社会化改革可以在多方面为大陆提供启示和借鉴。

After the internal reforms of judicial professionalism, specialization and independence ,Taiwan starts the external reform of judicial socialization. This reform is not only due to the urgent needs to change the condition that people do not trust the judiciary, but also depends on the achievement of a basic consensus and tireless promotion of various forces. The content of Taiwan＇s reform of judicial socialization consists of sociali- zation of role, socialization of personnel, socialization of management and socialization of trial, etc. Taiwan＇s re- form of judicial socialization can provide inspiration and reference in many ways to the Mainland.
