现代传播技术的发展,在扩展著作权保护范围的同时,也改变着著作权的监督-计量能力,进而使著作权制度发生改变,尤其是互联网和数字出版正在使传统的著作权制度面临崩坍的危险。在这样的背景下,该如何保护和鼓励知识创造呢?从商业模式的角度看,这只是收费方式的调整。在新环境下,知识创作者将会有更多的收入获取途径和形式。从这个角度观察著作权制度的变化,发现激励创造的新途径可能比修补已有法规的漏洞更有现实意义。

The development of modem communication technology, while expanding the scope of copyright pro- tection, also changes the supervision and measurement of copyright. Traditional copyright system is especially threatened by the Interact and digital publishing. This paper probes into how to encourage and protect knowledge creation in this context. From the perspective of business model, this is only an adjustment of the charge mode. In the new environment, knowledge creators will have new ways to obtain more income. From this point of view, the change of the copyright system and the discovery of the new ways of encouraging creation may be more realis- tic than the loopholes of the existin~ reaxdations.
