讯问过程中犯罪嫌疑人焦虑心理体验研究

Study on the Experience of Anxiety from Suspects during the Process of Interrogation

焦虑是人的一种具体心理体验,犯罪嫌疑人在被讯问过程中基于焦虑往往会作出有罪供述。和供述动机、供述原因不同,焦虑是犯罪嫌疑人的心理体验。犯罪嫌疑人基于焦虑作出的有罪供述是其理性的行为选择。为了促使犯罪嫌疑人作出有罪供述,侦查人员在设计讯问策略和讯问方法时应当重视犯罪嫌疑人的焦虑体验。在具体方法的选择过程中,应该遵循合法性、合理性和正当性的原则。

Anxiety is a kind of special psychological experience, and the suspect could confess because of anxiety in the process of interrogation. Anxiety is different from the confession motivation and the confession reason. Confession base on the anxiety is the suspect＇s rational choosing. The investigators should pay attention to the anxiety experience of the suspect to stimulate the suspect to confess when designing the interrogation policy and the interrogation methods. The principles of legitimacy, rationale and justification should be considered designing the special methods.
