冷冻胚胎的继承问题研究

科技发展改变人们的生活方式,冷冻胚胎技术改变人们的生育观念及生育行为。西方发达国家较早地面对冷冻胚胎技术,在相关理论上也较为成熟,主要有主体说、客体说、中介说三大理论。国内立法虽处于空白状态,但不乏学者对此研究,国内外多数学者认为冷冻胚胎应是具有双重属性的,即是物权客体属性与人格权客体属性的结合。冷冻胚胎具有双重法律属性特征,在继承权行使规则上也有别于一般继承的权利行使规则。

The development of science and technology has changed the way of people＇s life;similarly, technol-ogy of frozen embryos has changed people＇s attitudes and fertility behavior .Technology of frozen embryos has a long history in the western developed countries , which leads to a relatively mature theory system , including subject theo-ry, object theory and mediation theory .Although we don＇t have any domestic legislation ,some scholars begin work-ing on the frozen embryos .Based on the domestic and overseas research , frozen embryos are believed to have dual attributes, that is,the attribute combination of the object of property right and the right of personality .And we need to further our exploration about rules in succession of frozen embryos by studying those relevant western cases in or -der to put forward some legislative proposals .
