摘要
"小产权房"后遗症困境折射出了我国农民在集体土地增值收益分配中的权利贫困,土地增值收益作为"小产权房"隐射下土地发展权益的主要利益形态,必然成为各利益主体争夺的焦点。面对实践中众多的"小产权房"后遗症问题,集体土地增值收益分配应当尽快实现利益博弈下的利益均衡,在坚持社会公平和市场效率的基础上,以处理现有"小产权房"利益关系为契机,实现制度改革,提高农民土地及其增值收益。
The dilemma of sequel created by houses with limited property rights reflects the rights poverty of the Chinese farmers in the value-added income distribution of the collective land. Value-added land income as a main benefit form of land development rights and interests under houses with limited property rights will become the focus of competition for all stakeholders. Faced with many sequel Piroblems in the practice, the income distri-bution of value-added collective land should achieve the balance of interests under the game of the interests as soon as possible. On the basis of social equity and market efficiency and with handling the interests of the existing houses with limited property rights as an opportunity, the system is to be reformed and the farmers' land in- come is to be improved.
