摘要
我国公务员在管理国家事务中起着十分重要的作用。公务员在履行职责义务时,其权利可能会受到不同程度的侵害,但以现有的法律很难使其得到公正、合理的救济,这不但会挫伤他们的工作积极性,而且会影响其管理作用的发挥。本文以公务员权利救济途径为切入点,对公务员在行使、维护合法权益时出现的问题进行了分析,在此基础上,建议将公务员权利救济纳入行政诉讼,使其权益得到充分救济。
The civil servants in China play a very important role in managing state affairs.When the civil servants full their responsibilities and obligations,their rights tend to be damage on different degrees.But on the basis of the existing laws,when civil servants' legal rights and interests are violated,it is difficult to get a fair and reasonable relief;this sit- uation will not only hurt their work enthusiasm,but also influence its role in the management.This article takes the re- lief path of civil servant's rights as the point to analyze the problems existing in the process of the civil servant to per- form and safeguard their legitimate rights and interests,and thus suggest that the civil servant's rights relief should be included in the administrative litigation system so that the rights and interests can be fully relief.
