我国内幕交易罪刑法规制的困境与应对分析——基于立法与司法双重进路的展开

The Dilemma and Countermeasures Analysis of the Criminal Law Legal System of Crime of Insider Trading in China——Based on the Dual Approaches of Legislation and Judicature

无论是从立法上还是从司法上来分析,我国刑法规制内幕交易犯罪都存在一些问题,导致对内幕交易犯罪自治不力。因此,应从以下几方面入手进一步完善我国内幕交易犯罪的刑法规制:坚持法定入罪标准与司法实践追诉标准的协调、统一;出台具有可操作性的司法解释,夯实司法实践的规范依据;进一步完善刑罚制度,引入资格刑,增强惩罚的针对性和有效性;进一步强化行政执法与刑事司法、行政处罚与刑事处罚的无缝、立体、顺畅衔接,最大限度发挥"行刑合力";大力引进先进科技,建立健全交易监管数据库,强化侦查、取证、固证能力;加强司法队伍专业化建设,深化司法资源投入产出比的法经济学分析和效益评估,树立惩防并重、预防为主、事前事中事后立体联动的动态管控、标本兼治、治本为根的犯罪应对新理念。

Whether analyzing from legislative or judicial aspects,there are many issues in the crime of insider trading in our country so that the lacking of the autonomy of the insider trading.This paper argues that the further improving the criminal law of insider trading crime in China should from following several aspects：adhering to the coordinated and u- nified of the statutory standards and judicial practice incriminating prosecution standards;Issuing operable judicial expla- nation and consolidating the normative foundation of judicial practice;Further perfecting the penal system,introducing qualification penalty and enhancing the pertinence and effectiveness of punishment;Further strengthening the seamless, three-dimensional,smooth eohesion of the administrative law enforcement and criminal justice,administrative punishment and criminal punishment so that can maximize the ＂execution and joint forees＂;Vigorously introducing advanced tech- nalogy,establishing and perfecting the trade supervision database,strengthening the investigation,evidence collection,solid card ability;Strengthening the economical analysis and beneficial assessment of the judicial personnel specialized con- struction,deepening judicial resources input-output ratio of the law,establishing the new concept of dynamic monitoring, taclding and curing for the root of crime that emphasizing beth punishment and prevention, prevention first and three- dimensional linkage of before, in and after the issues.
