后危机时代国家间跨国公司社会责任制度体系的构建

On the Construction of the Inter-State Social Responsibility System of Transnational Corporations in the Post-Crisis Era

在新自由主义的主导下,最近几十年的国家间经济立法中,对"资本权益"的保护占据了核心位置,"国家与资本"、"资本与社会"之间的权利义务严重失衡,在制度上表现为国家间规范跨国公司社会责任制度体系的建构缺失。国际金融危机的爆发让国际社会反省了现有的全球治理模式,国家间经济立法的理念也做出了适应性的调整,并尝试着对"国家与资本"、"资本与社会"之间失衡的权利义务关系进行纠正。目前,无论是在理论准备上,还是在实践方面,都已为国家间建构跨国公司社会责任制度体系奠定了可行性基础。而采用双边、区域乃至多边等在内的"多头并进"立法模式,并根据具体情况选用"一揽子博弈"或"早期收获"之策略,运用"议题挂钩"之方法,乃为有效之途径。

Under the new liberal-led government,in the inter-State economic legislations during the recent decades,the protection on ＂capital interest＂occupies the centre,the rights and obligations between the ＂State and capital＂and the ＂capital and society＂are in serious imbalance. It appears that the construction of transnational corporations＇ social responsibility system between the countries is missing. The outbreak of international financial crisis triggered the international community to reflect the current model of global governance,and the ideas of inter-state economic legislation made the adaptive adjustment,in purpose of trying to correct the imbalance between rights and obligations of the ＂State and capital＂and the ＂capital and society＂. At present,either in theoretical preparation or in practice,it has laid the foundation of feasibility for the construction of inter-State social responsibility system of transnational corporations. In specific situations to adopt the ＂multiple forward＂（ such as bilateral,regional and multilateral） legislation modes,it will be a valid path by selecting the ＂basket game＂or ＂early harvest＂policies and using ＂linked to the question＂method.
