摘要
将区划与控规制度置于土地产权理论中分析,发现两者在规划技术控制上趋同,但在土地发展权归属和配置过程上却存在根本的差异。由于不同的制度"土壤",土地发展权的赋予和实施遵循着不同的产权规则,从而生成了区划和控规这两种不同的规划制度"结果",影响着各自的制度绩效和资源配置效率。因此,控规虽借鉴了区划中的技术,但是由于根植于不同的产权关系逻辑,与区划有着本质的区别。控规的制度设计必须符合我国社会的实际需求。
The study situates zoning by-law and regulatory plan in land property theory. It argues that flaough the two manifest to be similar in planning skills, they are fundamentally different in property rights arrangement. Born in different social institutions and abiding to different property rights rules, zoning by-law and regulatory plan have their impacts on their own performance as well as the efficiency of land resource allocation. Regulatory plan is essentially different from zoning by-law in that the two are rooted in different property right relationships, albeit the former draws on techniques from the latter. So the design of regulatory plan has to meet the actual demand of Chinese society.
