争议海域油气资源开发的最佳解决途径是共同开发,但南海争议海域油气资源共同开发却困难重重,面对这种困境,我国应该积极采取应对措施,促进争议海域油气资源的共同开发。首先,我国应进一步明确南海断续线内水域的权利主张;其次,我国应加强单方开发的力度,以促进共同开发协议的达成;最后,我国应正确对待先存权问题,在未来的共同开发中必须坚持公平原则,处理好先存权问题。

The best solution to development of oil and gas resources in the disputed waters is joint development. However there are lots of difficulties in the joint development of the South China Sea. Facing the difficulties, China should take some effective measures. Firstly, China should clarify and claim its rights within the dotted line waters of South China Sea; Secondly, China should enhance the unilateral development to help reach agreement in joint development; Lastly, China should correctly treat pre-existing rights. In the future joint development, the principles of fairness and pre-existing right should be adhered to.
