论公用型资源产品价格的法律规制

公用型资源产品的价格改革应在产业发展与民生保障之间实现平衡,构建符合市场规律的价格形成和变动机制,并保障公众的知情权、参与权和监督权。应在促进公用型资源产业发展的同时保障基本公用服务的民生需求,提升公用型资源产品的供给质量。公用事业企业不同程度地具有垄断性,应当在公用型资源产业或其不同环节引入竞争机制,促进公用事业企业的有效竞争。公用型资源产品价格的改革,当以价格法、竞争法、产业法与社会保障法等的功能组合构建相应的法律规制体系。

The reform of the price of public utility resource products should keep balance between the development of the industries and civil lives guarantying, construct the price-making and price- adjusting mechanisms meeting with the marketing rules, and guarantee the people＇s acknowledging rights, attending rights and supervising rights. We should promote the development of utility resource industries and guarantee the equal living demands on the basic public services, and improve the quality of the public utility resource products. The public utility corporations have some monopoly in different degrees, so the public utility resource industries or their different sectors should be embedded with competition systems so as to promote the effective competition. The price reform of the public utility resource products should construct the legal regulations framework by coordinating the price law, competition law, industry law and social guarantee law.
