传统行政强制类型之再造——以类型的开放性为视角

The Restructure of the Traditional Administrative Coercion Types:From the Perspective of the Openness of Types

新型行政手段在传统行政强制类型结构中无所归依,难以与现有法律相衔接,限制了其在实践中的适用和发展。"行政上实效性确保手段"是在纵向上以抽象的上位概念涵括新型手段,并在横向上创设新类型——其他新型手段,因未触动行政强制的内部结构,可称为"外部进路"。然而,循此进路,其他新型手段被排斥在与之并列的类型之外,内容上又存在交叉,更加难以定性。以类型的开放性特征予以检视,传统间接强制类型化为代履行、执行罚的结构并不完整,应设立与之并列的"其他间接强制"类型,使之向新型手段开放。传统行政强制结构内部的类型再造,可称为"内部进路"。新型手段应以在行政处罚、行政强制中定位为基础,以与现有法律相融合。

There is no position for the new type of administrative measures in the traditional administrative coercion types. The Measures of Ensuring Obligations and the Measures of Ensuring Effectiveness in Administration are abstract upper- seat concept to conclude the new type of administrative measures. At the same time,the new type named the Other New Type Measures is made on the crosswise. For the inner part of the traditional administrative coercion,we call it ＂the outside access＂. But,if we follow this access,the Other New Type Measures will intersect with other existed types,and it is hard to connect with the rules. Viewing by the openness character of the type,the traditional theory divides the Indirect Coercion into the Replace the Fulfillment and the Executive Forfeit is not an integral structure. The Other Indirect Coercion should be created to fulfill some new administrative measures. This kind of creating a type in the inner part of administrative coercion structure,we call it ＂the inside access＂. The new type of administrative measures should find their position under the type of administrative penalty and administrative coercion as many as possible,so that they can melt with the legal framework.
