摘要
救济类信访受理范围的任意扩大是信访功能异化的原因之一。促进信访制度功能回归是实现信访法治化的必然要求。功能回归也必须从信访受理范围的调整入手,而关键是实现救济类信访和非救济类信访分类受理。救济类信访事项的受理主体仅限行政机关,并且只有针对行政失当行为提起救济的事项属于信访受理范围。
The random expansion of the acceptance scope of the Letters and Visits functioning as remedy is one of the reasons for function changes of Letters and Visits. Promoting regression of the function of Letters and Visits system is a necessary requirement for legalization. The key to regression is realize the classity of acceptance of remedy and non-remedy types. The accepting entity of remedy type shall be limited to administrative authorities,while the acceptance scope shall be limited to the remedy claim against inappropriate administrative act.
