我国环境修复基金来源途径刍议——以美国超级基金制度为视角

The Sources of Funds on China's Environmental Remediation:From the Perspective of the U. S. Superfund

我国现行立法对环境修复费用的来源没有明确且具体之规定,造成环境修复过程中费用的来源存在困境。以美国超级基金制度为分析视角,借鉴其有关资金来源保障措施的立法经验,有利于为建立适合我国国情的环境修复基金来源途径提出具有建设性的立法构想。

The unclear and unspecific provisions on sources of environmental remediation funds in existing laws cause difficulties in raising the money during the recovery of environment. Based on the system of the U. S. Superfund, the thesis is aimed at using the legislative experience on protective methods of sources of envi- ronmental remediation funds to put forward a constructive design of legislation for our nation＇ s sources of funds in protecting environment.
