当代中国法治建设承载的历史使命及发展的基本路向

The Historical Mission and the Basic Direction of the Development of Chinese Current Construction of Rule of Law

党的十八届四中全会首次将法治作为主题,提出了全面推进依法治国,建设中国特色社会主义法治体系,建设社会主义法治国家的重大决策。因此,在新的历史时期,大力加快法治建设就成为现实所需。但对于处于特殊历史时期的中国而言,在认清当代中国法治建设所承载的历史使命的基础上,进一步从当代中国法治建设的物质基础、价值取向及运作机制等三个方面探寻当代中国法治建设所应遵循的基本路径等,不仅是推进当代中国法治建设进程的必要前提,同时,对进一步加快当代中国法治建设的步伐也具有重要意义。

In the fourth plenary session of the 18th Central Committee, the rule of law as the theme for the first time was proposed. This session also proposed the major policy decisions and arrangements to comprehensively promote the rule of law, to construct the socialist legal system with Chinese characteristics, and to build the socialist country ruled by law. Therefore, in the new historical period, accelerating the pace of construction of rule of law has become a realistic need. But in the author＇ s opinion, as far as the special historical period of China was concerned, on the basis of recognizing the beating of historical mission, further exploring the basic direction for the development of the current construction of Rule of Law from the three aspects： the material basis, value orientation and operation mechanism, is not only a necessary prerequisite for promoting the process of constructing Rule of Law, simultaneously also is the very important meaning to further accelerate the pace of constructing Rule of Law in contemporary China.
