建设项目环境影响评价的分类管理机制之重构

在"GDP至上"发展模式下,环境污染加剧、资源枯竭等问题已成为困扰人类的社会性问题。《中华人民共和国环境影响评价法》(以下简称《环评法》)的诞生与实施使环境管理模式由"末端控制"转变到"源头控制"成为可能。但是《环评法》实施十年过程当中,暴露出不少理论和操作层面的问题。本文鉴于当下的环境危机和《环评法》实施中的松、乱、假现象,把视角转移到《环评法》制度设计的具体问题,从回顾与分析环评对象范围入手,为环境影响评价的分类管理的重构略谈自己见解。

Under the mode of GDP-First, problems such as the severe environment pollution and the resources exhaustion have become social difficulties. The birth of Environmental Impact Assessment Law makes it possible for the management mode to transfer from end-control to source-control. But during the implement process of the law in the past ten years, a lot of problems both in theory and practice have been exposed.Considering the current environmental crisis and the lax management, disorderly market and deceive behavior in the implement, the paper focused on the specific issues of the system design for the law. With the review and analysis of EIA object, the reconstruction of classified management of EIA was put forward.
