摘要
个人信息档案兼具财产权与人格权(人身权)的双重属性,从权利本源上讲,个人信息档案所涉及的"个人"才是个人信息档案的真正权利主体,他们应当真正具有支配个人信息档案的主体权利,即信息自决权,包括参与"对国家和社会具有保存价值"的个人信息的认定、个人信息权利主体的知情权、个人信息主体利用个人信息档案的权利和征得"个人"同意的他用。
Personal information archives have dual attributes of both property right and personality right. From the origin of power, ＂individuals＂ involved in personal information archives are the real subject of right of personal information archives, and they should have real fights to dispose personal information, namely the right to self - de- termination, including participation in the personal information cognizance, which has the preserved value to the state and society, the right to know for the right subject of personal information, the right to use personal informa- tion files as the subject of it, as well as to use it for other purposes with the consent of ＂individuals＂.
