Study on the Country Compensation for the Victims of Voluntary Actions against Injustice

见义勇为行为是我国的传统美德,但是当前不少见义勇为行为却遭遇了尴尬,使得见义勇为受害者的权益得不到保障。本文从见义勇为行为的当前遭遇的尴尬境地、原因入手,首先提出了见义勇为者损失的国家补偿责任,阐述了见义勇为的概念、内涵和将见义勇为者损失纳入到国家补偿的意义,最后提出将见义勇为者损失纳入到国家补偿的具体措施。文章明确了见义勇为受害者国家补偿责任,提出见义勇为行为应采用国家先行补偿原则。

Voluntary actions against injustice is one of the traditional virtues of our country, but currently many of such actions suffer an embarrassment, which makes the rights of victims of voluntary actions against injustice un- guaranteed. From the heroic embarrassing position and reasons of the current situation, this paper proposes the country compensation liability, expounds the concept and connotation of voluntary actions against injustice, as well as the significance to put the losses of victims into country compensation. In the end, it lists concrete measures a- bout how to put it into practice. It explicates the national compensation responsibility for victims and put forward the adoption of country leading compensation principle of victims of voluntary actions against injustice.
