当代中国关于法律移植的认识深刻地镶嵌于时代背景之下,历经了正名法律移植、设计法律移植和否思法律移植三个阶段。这三阶段既是一种历时性演进、推演张开,又是一种共时性的存在、陈陈相因。设计法律移植和否思法律移植阶段所呈现的"二元对立式的法律移植观"使法律移植的认识面临着一系列的困境。当今"现代性"与"全球化"的深入展开成为目前中国所处的最为显著的新时代背景,使以往影响法律移植的因素发生了改变。法律移植的认识由此面临着逻辑转换。在以往对法律移植认识的基础上以及新的时代背景之下,"实践理性法律移植观"力求做到移植过程中工具理性与价值理性的统一,把法律移植放入全球化和现代性的整体性格局中去考察和评判,以形成一条既与全球法律文明相沟通又具有民族特色的法律发展道路。
