公益诉讼具有引导及纳入现代问题如环保、公害、消费者保护、大众投资、公共支出等等于体制内解决的作用。就鼓励私人关心公益、促进制度改革及稳定社会、督促公务员依法行政、培育政府责任感的作用等方面,说明公益诉讼可能发生的功能,以期在制度运作时,时时警惕,是否制度已偏离原有轨道而应有所修正。

Public interest litigation possesses the function of guidance and incorporate modern problems which are solved within the system such as environmental protection ,pollution ,consumer protection , public investment ,the role of public expenditure ,and so on .The functions that may occur in the public welfare lawsuit was illustrated in the article such as encourage private concerned about public welfare ,pro‐mote the reform of the system and social stability ,urge civil servants administration according to law ,and fostering the role of the government responsibility and so on ,in order to remain vigilant at all times in the process of system operation ,w hether the system has deviated from its original orbit ,and should be correc‐ted .
