Local Legislative Breakthrough and Trend in Legal System of the Protection of Power Facilities

在国家层面关于保护电力设施的法律规范滞后、缺项的背景下,各地特别注重保护电力设施立法,丰富完善了电力法律制度。文章从电力设施范围、电力设施保护区、电力设施保护标志、电力设施保护工作机制、"线房"、"线树"矛盾、破坏电力设施禁止性规范、爆破作业、废旧电力设施器材设备购销、运维抢修电力设施、紧急避险等10个方面介绍了地方立法关于电力设施保护法律制度的创新、突破与立法的新趋势。

At the lag and lack of state-level legislation of protection of power facilities, various places pay great attention to local legislation, and further refine the legal system of protection of power facilities. This paper attempts to introduce the innovation and breakthrough of the legal system of the protection of power facilities and the new trend of legislation from ten aspects, including the scope of power facilities, the power facilities protection zone, the protection marks of power facilities, the power facilities protection mechanism, the conflict between power lines and buildings as well as plants, the sabotage of prohibitive provisions, the explosion, the purchase and sale of waste power facilities and equipments, the operation, maintenance and urgent repair of power facilities, act of rescue.
