浙江省环境污染责任保险研究

On Liability Insurance of Environmental Pollution in Zhejiang

环境污染责任保已经在浙江省试点了几年,但是效果并不理想。在对浙江省环境污染责任保险的现状、存在的问题及原因进行分析的基础上,借鉴国内外环境污染责任保险发展经验,对浙江省环境污染责任保险该如何发展提出了建议:加强环境污染赔偿的立法建设,实施强制保险制度,政府提供配套支持。而且浙江省有条件在全国建立环境污染强制责任保险之前,由省政府相关部门推动,以共保体的方式扩大环境污染责任保险的覆盖面。

Liability insurance of environmental pollution has been piloted in Zhejiang for several years, but the result was not satisfactory. So, this article firstly studies the current situation, and analyses the problems and the sources of problems of liability insurance of environmental pollution in Zhejiang. Secondly, based on the experiences of foreign countries and other provinces, this article gives some suggestions of the development strategies to the liability insurance of environmental pollution in Zhejiang： Enhance the legislation processes regarding compensation for environmental pollution; enforce compulsory insurance; and provide governmental support. Finally, this article puts forward that Zhejiang has the advantage of expanding the coverage of liability insurance of environmental pollution in form of co-insurance under the impetus of government before the establishment of national compulsory environmental pollution liability insurance.
