摘要
以"控辩"技能人才培养作为法学教学模式,符合法学专业的生存和发展需要。"控辩"技能人才是指具备主动主张权益和被动抗辩他方主张基本技能的法律专门人才。"控辩"技能包括起诉和应诉技能、法庭辩论技巧、法律语言技巧、询问技巧、法律文书技能等。为实现控辩技能人才的培养目标,法学教学需要转换教学理念让学生回归教学主体地位,以此保证学生在"控辩"技能训练中的主体地位;在教学手段上,利用"双师教学"模式展现"控辩"技能的魅力,激发学生参与"控辩"技能训练的兴趣;在教学实践中,学生充当控、辩不同角色,践行"控辩"技能。
Using "sue-defense" skills talent cultivation as law teaching mode, it meets the requirements of the survival and development of the law major. The "sue-defense" skills talent has the basic skills of legal professionals to claim rights actively and defense the other's claim passively. The "sue-defense" skills include the prosecution and responding skill, the law debating skill, the legal language skill, the inquiry skill, the skill in the legal document, etc. To achieve the training objectives of the "sue-defense"skills talent, law teaching needs to transform teaching concepts, that is, let the students return to the main body status, so as to ensure the subject status of the undergraduates in the "sue-defense" skill training. As for the teaching methods, it uses the "double teachers" mode to show the charm of the "sue-defense" skills, and stimulates the undergraduates' interest to participate in the "suedefense" skills training. In teaching practice, the undergraduates play the role of an accuser or a defender and practice the "suedefense" skills.
