摘要
在劳动合同冲突法领域,意思自治是法律赋予当事人选择劳动合同准据法的一种自由,但是由于各种原因,法律又从空间、时间、内容等方面对其施加限制。如此诸多的限制,构成了意思自治的外部界限,框定了意思自治的范围,当事人只有在此范围内选择劳动合同准据法方才有效。
In the sphere of conflict of laws in employment contracts, the party autonomy principle is a kind of freedom provided by the law to the parties to choose the applicable law for the employment contract. At the same time, for several reasons, the law imposes restrictions on this kind of freedom from vari- ous aspects such as space, time and content etc. These restrictions outlined the outer limits and scope for the party autonomy principle. The applicable law of the employment contract is only valid when chosen by the parties within the scope of party autonomy.
