论数字时代的著作权集体管理制度

On the Collective Management System of Copyright in the Digital Era

以著作权集体管理制度的标准、要求和职能审视了数字时代我国著作权集体管理的发展现状,通过与发达国家同类管理制度发展态势的比较,探讨了我国著作权管理制度在数字时代面临的挑战。从重新定位集体管理制度中角色、维护运作的公开和透明性、确定合理的相关费用标准、规范著作权集体管理信息系统的开发四个方面,提出了全面完善数字时代我国著作权集体管理制度的措施。

This paper examines the current development situation of collective management of copyright in the digital age based on the standards, requirements and functions of the collective management system of copyright. By comparison with the similar development situation of management system in developed countries, it discusses the challenges of copyright management system in the digital age. Finally, it puts for- ward improvement measures of this system from the four aspects of repositioning the role of collective management system, maintaining an open and transparent operation, determining reasonable clearance fee standards, and standardizing the development of information system of copyright collective management.
