行政合同作为一种柔性行政管理手段,在当代行政执法中被广泛应用。由于行政合同具有提升相对人法律地位、提高人民接受程度、丰富行政手段、限制行政机关独断专行等功能,与当代民族事务管理具有内在契合性。在民族自治地方行政执法实践中,应当特别注意行政合同在计划生育、目标责任、教育、国有土地出让、特许经营、旅游开发与非物质文化遗产保护等领域的应用。

Administrative contracts are widely used in modern administrative law enforcement as a kind of flexible administrative means. Due to the administrative contract can increase the relative legal status, improve the people＇s acceptance function,rich administrative means,prevent the administrative organs to be a law onto oneself,it is consistent with the national affairs management. In the national autonomous areas the practice of administrative law enforcement,particular attention should be paid to the application of administrative contracts in the fields of family planning, target responsibility, education, the state-owned land, franchising, tourism development and protection of intangible cultural heritage.
