公安监所管理体制改革分析与展望

Analysis and Prospect on the Reformation for Management System of Public Security Prison

我国公安监所管理体制改革的话题一直以来备受关注,至今为止,公安监所管理体制改革的争论及研究一直没有间断。关于公安监所管理体制改革的争议主要涉及两个方面:一是看守所是否从公安分离出去;二是公安监所内部的管理体制改革与创新。对于看守所是否从公安分离一直以来有赞成和反对两种不同意见,对于公安监所未来的归属也有不同的构架:有人认为应划归司法;有人认为应当成立独立的羁押机构;有人认为在押人员拘留期间归公安管理,逮捕后归司法管理。笔者认为,公安监所管理体制改革是未来发展的趋势。但鉴于目前我国的实际情况和实施的可行性,可在维持现有体制的情况下,进行监所内部管理制度的改革和创新,如监所医疗社会化改革、监所对社会开放等,以适应我国法治发展的需要。

The topic of reform for the management system of public security prison in our country has attracted much attention all the time.The controversy mainly involves two aspects:firstly,should the detention center separate from police system;secondly,the reform and innovation of the internal management of public security prison.There are pros and cons about this issue,some argues that it should be classified under criminal justice system,some advocates to establish independent custody institutions,the others claim that the detainees should be controlled by police agencies during custody,and then they were transferred to criminal justice administrative agens after arrested.In the authors' opinion,the reform on management system of public security prison is the future trend.However,in view of the reality of our country and the feasibility of implementation,the reform and innovation of prison internal management system should be conducted to adapt the development of legal system in our country(e.g.socialization reform of prison medical system,or opening of prison to society),while maintaining the existing system.
