“越位”的专家与“隐身”的法官——专家参与在司法过程中的合理定位

Offside Experts and Invisible Judges

专家系统介入司法过程是司法程序必不可少的一环。由于专家与法官分属不同的"认知共同体","专家意见"的价值有待澄清。在司法过程中,专家参与存在一定的偏差、错位或越位现象,无论是专家还是法官均面临严重的信用危机。专家参与的制度建构需要遵循相应的原则和路径:第一,通过独立性、透明性保障专家的司法参与;第二,通过决策保障制度、反腐败制度的法治化重建法官的权威。

The expert system involved in the judicial process is an indispensable part of the judicial procedure. Because of experts and judges belong to different ＂epistemic community＂, the value of ＂expert opinion＂ have to be clarified. In the judicial process, the experts participate exist a certain bias, misplaced or offside phenomenon, whether experts or judges are facing se- rious credit crisis. The construction of an expert＇s participate system need to follow the appropriate principles and paths： first, by the independence and transparency guarantees the participation of experts in the judiciary process; second, by decision secur- ity system and rule of law about anti--corruption regime to reconstruction judge authoritativeness.
