规范争论与协商介入:中国对不干涉内政规范的重塑

Norm Contestation and Deliberative Involvement:China's Remodeling of the Non-interference Norm

自主权国家普遍确立以来,不干涉内政作为现代国际体系的核心规范一直不可动摇。然而,冷战结束以来的人权规范尤其是"保护的责任"规范却正在动摇不干涉内政规范的核心地位。面对不干涉内政规范遭遇的理论挑战与中国特色大国外交的现实需求,中国必须发展出既满足中国现实利益需求又符合国际社会需要的全球治理学说。基于中国特色协商民主传统的"协商介入"治理路径正在成为中国贡献给世界的中国智慧与中国方案。结果性逻辑与适当性逻辑均无法恰当解释中国外交这一规范重塑行为。协商介入治理路径实现了真正意义上的规范创新与重塑,从以争论性逻辑为基础的规范争论视角出发,方能给出恰当的解释。

With the widespread establishment of sovereign states,the princeple of non-interference in the internal affairs has been unalterable and unchallenged as the corestone norm of modern international system.Nevertheless,the norm of human rights maily developed after post-Cold War particularly the norm of 'responsibility to protect',is challenging the non-interference norm.Confronted with the theoretical challenge to the non-interference norm and the practical need of expanding oversea interests,China has to develop a theory of global governance which can both satisfy the practical need and go in line with the international trend.A governance approach of 'deliberative involvement' derived from China's special tradition of deliberative democracy is becoming the Chinese wisdom and solution that China contributes to the world.Neither the logic of consequence nor the logic of appropriateness can explain the norm-remodeling of China's diplomacy. 'Deliberative involvement' has realized a true norm innovation and remodeling.Only normative contestation based on the logic of arguing can provide a proper explanation.
