摘要
我国出租车行业实行的是以政府为主导的特许经营模式,政府出于为公用事业的考虑,认为对其采用特许经营才能更好调节市场,优化社会资源。但此种模式本身存在弊端,车租车司机的合法权利没有受到应有的保护,集体性事件频发。因此,本文从域外出租车管理模式的分析角度出发,具体分析了香港、台湾、英国和美国的管理体制,并对我国出租车行业的管理提出放松管制、破除垄断是关键,加强行业协会管理发展是手段,保护出租车司机合法权益是目标等建议。
The taxi trade in China is regulated by government in franchise model,which can be classified into corporatization mode,affiliation mode,cooperation mode and individual mode. The government,who considers the taxi trade as public utili-ties,holds that only the franchise mode can regulate the market and optimize resource allocation. However,some deficiencies also exist in this mode. Taxi drivers,whose legal rights cannot be protected from this mode,often initiate mass incidents. Therefore,this paper analyzes the operation systems of taxi trade of Hong Kong,Taiwan,Britain and American respectively, and makes some suggestions like deregulation,break monopoly,strengthen the development of taxi trade associationand protect driversˊlegal rights.
