剩余胚胎去向的伦理法律规制思考

Ethical and Legal Reflections on the Remaining Embryos after IVF

随着体外受精-胚胎移植技术的快速发展,剩余胚胎去向问题是其应用过程中需要面对的一个社会问题,如剩余胚胎的基本权、继承权和归属权问题。从医学伦理学角度出发,对胚胎地位问题进行简要分析,阐述了剩余胚胎的冻存、医学方法废弃、捐献他人、科学研究所引发的伦理法律问题,并提出完善胚胎冻存管理制度,规范保存行为,合理安排胚胎处理流程,确定废置标准,加强培养研究规范管理,深化胚胎捐献认知体系等建议,以杜绝一些违规行为的发生。

Along with the advance of IVF-ET technology, how to deal with the remaining embryos produced some social problems, including the fundamental rights, inheritance rights and the ownership of the remaining embryos. This article briefly analyzed the status of embryos and the ethical and legal issues concerning frozen, abandon, donation and doing research of the remaining embryos. Finally, this paper proposed to establish and improve the management of frozen embryos, regulate preservation of remaining embryos, establish criteria for discarding remaining embryos, improve management of embryo research and increase public awareness of embryo donation.
