摘要
集体谈判对于解决职业体育行业劳资纠纷具有重要意义。域外职业体育行业集体谈判制度成熟完善,包括健全的劳动立法制度和司法审判原则、行之有效的职业体育行业集体谈判运行机制,以及令人瞩目的劳资集体谈判合作趋势。这些经验做法给我国带来包括加强职业体育劳动立法、落实工资集体协商制度、完善职业体育行业监管机制以及建立职业运动员工会维权组织等重要启示。
Collective negotiation is very important way to solve the professional sports industry labor disputes. Foreign profes- sional sports industry collective bargaining system has been mature and perfect enough, including sound labor legislation sys- tem and judicial principles, effective professional sports industry collective bargaining mechanism, and remarkable coopera- tion trend in collective bargaining. These practices and experiences brought us important enlightenment such as to strengthen professional sports labor legislation, implement salary collective consultation system, perfect professional sports industry su- pervision mechanism and is helpful for us to set up a professional athletes union organization, etc.
