谋利空间的形成:对城管违建执法困境的分析

The Formation of the Benefit- seeking Space:An Analysis on the Plight of the Law Enforcement of Illegal Construction

违法建设是我国城市化过程中的一个重要问题,并形成突出的执法困境,而谋利型违建是违法建设问题中最为突出的一种类型。本文基于在整合主义进路的下研究违建执法困境问题,通过分析在特定的治理机制下,执法过程中的执法主体与其他主体之间的具体互动过程,考察其中的组织能力和沟通协调关系,侧重揭示违建执法过程中处于灰色地带的违法建设谋利空间的形成机制,探究其与违建治理困境之间的内在关联。研究发现,谋利型违建的普遍化是当前中国社会存在诸多灰色利益空间的表现。当前的违建治理机制是中国当前"上下分治"体制的产物,具有较强的稳定性。谋利型违建的治理过程实际上成为利益调节过程,而非单纯地执法问题。如何处理和协调违建执法困境中的谋利空间问题,依然会是违建执法的核心难题。

In the process of urbanization,illegal construction has become an important issue,appearing to outstanding the plight of law enforcement. There are various types of illegal construction,and the most salient one is benefit- seeking one. The paper studies illegal construction under the guidance of combinationism approach to the enforcement dilemma. This research analyzes the specific interaction between the law enforcement subject and other subjects during the law enforcement process under special governance mechanism. Moreover,it investigates the organizing ability and communication and coordination relations among them. By focusing on revealing the forming mechanism of the illegal construction benefit- seeking space which is in the grey zone,we can figure out the interrelation between it and the plight that the law enforcement of illegal construction meets. The generalization of profit illegal construction is the consequence of current performances of many Chinese social interests gray space. The current governance mechanism of illegal construction,which is of great stability,is the product of China＇s ＂Vertically Decentralized Authoritarianism＂governing system. As a matter of fact,instead of being a pure process of law enforcement,the governing process of benefit- seeking illegal construction is the process of interest adjustment. How to deal with and coordinate the benefit- seeking space problem that appears in the law enforcement process becomes the core issue in the governance of illegal constructions.
