行政执法实践中,一方面面临着裁量基准失准、失范的困境与挑战,另一方面又承受着司法案例指导制度蓬勃、壮大的吸引与诱惑。行政案例指导制度,作为行政法治保障新路径,多省(市)已迈出探索步伐。但是,作为实践中刚刚起步的探索性制度,又面临着诸如基础性理论、可行性论证、出路性探索、实践性运用等研究不足的具体挑战,亟需构建统一的行政案例指导制度,探索行政案例指导制度的具体设计、参照适用,并使其回归到行政法治的建设目标中。

In the practical administrative enforcement,we are facing the difficulties and challenges of discretion benchmark＇s misalignment and anomie,and also the attraction and temptation from judicial case guidance system＇s vigorous growth.Useful explorations of administrative case guidance system as a new path that guarantees administration under law,are on the way in many cities and provinces.But as a nascent probing system in practice,it is faced with some specific challenges of insufficient study in such fields as basic theory,feasibility,outlet line exploration and practical use,which calls for the unity of administrative case guidance system in China.We should explore the specific design and reference application of administrative case guidance system,and make it return to the goal of administrative rule of law.
