"巡回"一词既是对西方先进司法体制的引进,也是对中国历史审判体系的传统沿革,在中国最高人民法院设置巡回法庭,其中心思想在于中央司法集权的分散。中国的司法体制改革为巡回法庭的设置创造了优越条件,使其在中国的存在有相当的可行性与必要性。同时,中国最高人民法院设置的跨区域巡回法庭也面临着许多挑战,主要表现在机构调整、司法资源、财政经费等方面,面对诸多问题,中国应结合自身国情有的放矢。

The word ＂ tour＂ is the introduction of the advanced western judicial system,and is also the traditional history of the Chinese historical justice system. Setting up circuit court in China＇s Supreme People＇s court,the central idea is to disperse the central judicial authority. The reform of the judicial system creates favorable conditions for the circuit court settings in China,which makes its existence in China necessary and feasible. At the same time,the inter- regional circuit court set by China＇s Supreme People＇s court is faced with many challenges,which is mainly manifested in the following aspects： organization adjustment,judicial resources,and fiscal funds. Facing many problems,China should combine its own conditions and have a definite object in view.
