草原承包经营权探析

A Discussion on Contractual Right of Grassland

我国牧区实行草原承包经营制度以来因草原承包经营权的设置未将环境功能纳入视野,片面强调草原承包经营权的行使实现和在此基础上体现的经济价值,造成对草原的掠夺式经营。应正确认识草原承包经营权的物权法性质,完善草原承包经营制度,明确草原承包经营权的生态化,以保障牧民合法权益,促进草原畜牧业多种经营模式的发展,实现草原的可持续发展。

Implementing grassland contract management system in pastoral area in our country, exploitation management is caused due to not taking environment function into account while establishing contractual right of grassland and unilaterally emphasizing the exertion and realization of the right and related economic value based on it. To realize the sustainability and guarantee the herdsmen ＇ s legislative rights we should determine the real - right - law attributes of contractual right of grassland and its ecologization, improve contract management system, and promote diversification mode of grassland husbandry.
