网络过失行为犯罪化研究

On the Criminalization of Internet Negligent Act

对于网络过失行为的惩罚,是对网络过失行为造成危害结果的惩罚;对于网络过失行为的预防,是对网络过失行为在危害结果发生前的预防。网络过失行为犯罪化的根据在于网络过失行为人的犯罪心理,其包括引起网络过失行为的动机和肯定危害结果的罪过两个部分。网络过失危害行为犯罪化的标准由三个条件构成,即犯罪化的重要性、必要性和可行性。网络过失行为成立犯罪的类型包括过失危险犯和过失结果犯两种情况。

For network negligence, the result of punishment is explained by the fact that a harm to network. For prevention network negligence, it is forwarded to the harmful results. Criminalization foundation is based on the motivation psychology and the culpability of the admitting harmful consequences. Criminalization standard of network negligent act is composed of three conditions, namely the criminalization importance, criminalization necessity and criminalization feasibility. Criminal types of Intemet negligent act include the negligent dangerous crimes and negligent results crimes.
